Welcome to MeadowThreadLoom ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at meadowthreadloom.sbs (the "Service") operated by MeadowThreadLoom.
By reserving a charter or utilizing our Service, you consent to be obliged by these Terms. Should you reject any portion of these terms, then you are not permitted to access the Service.
2. Service Overview
MeadowThreadLoom offers elite yacht charter services, encompassing:
- Daily yacht rentals
- Sunset cruises
- Business retreats
- Exclusive gatherings
- Extended charters
All offerings are dependent on accessibility and climatic conditions. We maintain all authority to change or discontinue services without notice.
3. Booking and Reservations
3.1 Booking Process
To arrange a charter, you are to:
- Attain the minimum age requirement of 18 years
- Submit precise and complete information
- Remit the required security payment as detailed in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed booking is contingent upon the receipt of your payment and our affirmative written communication. Service can be declined at our discretion to any individual.
3.3 Availability
All charters are subject to the availability of vessels and appropriate meteorological conditions. We will strive to fulfill your requests for specific dates and timings.
4. Payment Terms
4.1 Pricing
All charges are expressed in € and cover all relevant taxes unless specifically excluded. Costs may be adjusted without advance notice.
4.2 Payment Schedule
- Deposit: 50% of the total charter price payable upon booking
- Remaining Balance: Due 48 hours prior to the charter's departure
- Incidental expenses (as applicable): Due upon charter's end
4.3 Payment Methods
Major credit cards, bank transfers, and certified bank drafts are honored. Payment processing is conducted securely with encryption.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours prior to departure: Full reimbursement minus handling fees
- 24-72 hours before departure: Partial refund of 50%
- Under 24 hours before departure: No reimbursement
5.2 Weather Cancellations
Should the captain deem the weather conditions unsafe, we will propose to:
- Postpone your charter to an alternative date at no added cost
- Issue a complete refund if rescheduling proves impracticable
5.3 Mechanical Issues
If there are mechanical complications with your assigned vessel, we will attempt to provide an appropriate substitute. Should this not be feasible, we will issue a full reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
All guests are expected to:
- Heed all instructions given by the crew
- Don safety gear as instructed
- Declare any health conditions that could affect their safety
- Stay within assigned areas on board the vessel
6.2 Prohibited Items
Boarding with the following items is not allowed:
- Glassware
- Illegal substances
- Firearms or weaponry
- Excess consumption items (beyond a reasonable limit)
- Pets (unless given prior authorization)
6.3 Conduct
Passengers are required to behave respectfully. Any charter can be terminated early without compensation if a passenger's conduct poses a risk to safety or causes disruption to others.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount expended on your charter. We are not accountable for:
- Personal harm due to guest negligence
- Losses or damage to personal belongings
- Indirect, consequential, or exemplary damages
- Delays due to adverse weather or other conditions outside our control
7.2 Insurance Coverage
Our operations, including the vessels, are insured under comprehensive marine insurance policies. It is the passengers' responsibility to obtain their own travel and personal insurance.
7.3 Assumption of Risk
Engaging in our charter services implies recognition of inherent risks associated with sea-related activities and you accept personal responsibility for your security and well-being.
8. Modifications and Itinerary Changes
Itinerary, routes, or schedules may be altered as necessary due to weather conditions, safety needs, or operational demands. Efforts will be made to offer similar experiences wherever possible.
9. Force Majeure
We will not be held accountable for any delays, cancellations, or changes caused by events beyond our direct influence, including but not restricted to:
- Extreme weather cases
- Natural disasters
- Regulatory decrees
- Harbor closures
- Mechanical breakdowns
10. Privacy and Data Protection
Your private information is managed under the guide of our Privacy Policy. Your use of our service implies consent to the gathering and use of your data as outlined in that policy.
11. Intellectual Property
The material found on our website, such as text, visuals, brand marks, and images, is secured by copyright and trademark regulations. Unauthorized reproduction, distribution, or the creation of derivative works is banned without explicit written authorization.
12. Governing Law
These Terms are regulated by the laws pertinent in Monaco. Disputes will be handled in the courts of Monte Carlo, Monaco.
